These Terms of Service (“Terms”) constitute a legally binding agreement between The Q Company, operating Naviqate (“we,” “our,” “us”), and any individual or entity (“you,” “your,” “user”) who accesses or uses the Naviqate application (“App”).
By using the App, you agree to be bound by these Terms. If you do not accept these Terms, you must not use the App.
Definitions
- “App” means Naviqate, the indoor navigation platform owned by The Q Company.
- “User” means any person accessing the App, including end-users and business subscribers.
- “Services” means the provision of indoor navigation, account management, and related functionality.
Eligibility
- Users must be at least 16 years of age or have parental/guardian consent.
- By using the App, you represent that you meet eligibility requirements.
Account Registration
- You must provide accurate and complete information for registration.
- You are responsible for safeguarding login credentials..
- Unauthorized use of another account is prohibited.
Acceptable Use
Users must not:
- Use the App for unlawful, fraudulent, or abusive purposes.
- Attempt to hack, disrupt, or reverse-engineer the App.
- Upload malicious code, viruses, or harmful material.
- Interfere with the operation of servers, APIs, or cloud services.
Violation may result in suspension or termination.
Services Provided
- Naviqate provides indoor navigation services across supported venues (e.g., malls, airports, hospitals).
- Services may be updated, modified, or discontinued without prior notice.
- We do not guarantee uninterrupted service or error-free navigation.
Payments
- End-users are not charged.
- Businesses subscribing to Naviqate pay fees via trusted third-party payment providers.
- We disclaim liability for payment disputes with such providers.
Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated by reference.
Intellectual Property
- Naviqate is not intended for children under 16 years of age.
- We do not knowingly collect data from children under 16 without parental/guardian consent.
- If we learn that personal data of a minor has been collected without consent, we will delete it.
International Compliance
- All software, 3D models, content, logos, and trademarks are owned by The Q Company.
- Users are granted a limited, non-transferable, non-exclusive license to use the App.
- Unauthorized copying, modification, or resale is prohibited.
Disclaimers
- The App is provided “as is” and “as available” without warranties of any kind.
- We do not guarantee uninterrupted service, accuracy, or fitness for a particular purpose.
Limitation of Liability
- To the maximum extent permitted by law, The Q Company shall not be liable for indirect, incidental, or consequential damages.
- Our liability shall not exceed amounts actually paid (if any) for the services.
Indemnification
You agree to indemnify and hold harmless The Q Company from any claims, damages, or expenses arising out of your misuse of the App or violation of these Terms.
Termination
We reserve the right to suspend or terminate accounts:
- For violations of these Terms.
- If required by law or security reasons.
- At our discretion, with or without notice.
Modifications to Terms
We may modify these Terms at any time. Continued use constitutes acceptance of the revised Terms.
Force Majeure
We shall not be liable for failure or delay caused by events beyond our reasonable control, including natural disasters, internet outages, strikes, or government restrictions.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
Governing Law
These Terms are governed by the laws of India, State of Maharashtra.
